Communal violence bill back on table |

NEW DELHI: .The cabinet will also consider thawing another bill — Communal violence (prevention, control and rehabilitation of victims) — which was drafted in 2005. It has been controversial proposal criticised both for being inadequate as well as for intruding into the states' domain. But the decision to bring it to the cabinet indicates the government is looking to consolidate its "secular" credentials and build on the support that it feels minorities have extended to it.
The bill contains a clause that allows the Centre to declare an area in a state as communally disturbed. Though deployment of force would require a request from the state concerned, the bill would certainly give the Centre leeway in putting a state government under a scanner. Several other provisions are part of the regular powers enjoyed by any administration but has clauses that stipulate three years imprisonment for violation of section 144 — illegal assembly — in a communally disturbed area.
Special courts will be set up to try cases registered in a communally disturbed area. The Bill also provides for Supreme Court to transfer cases from one court to another and take steps to protect witnesses. The Cabinet on Thursday is also expected to consider a bill regarding amendments to the CrPC.
